These Terms of Service (“Terms”) govern your access to and use of CSAgentIQ’s website and AI receptionist services. Please read them carefully. If you do not agree to these Terms, do not use the Services.
1. Acceptance of Terms
By accessing or using CSAgentIQ’s website, products, or services (the “Services”), you agree to be bound by these Terms of Service. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Description of Service
CSAgentIQ provides an AI-powered receptionist and communications platform that answers calls and messages, books appointments, captures leads, and integrates with third-party tools. We may add, change, or remove features over time.
3. Accounts and Registration
You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Subscriptions, Fees, and Billing
Paid plans are billed in advance on a recurring basis according to the plan you select, plus any applicable usage-based charges and taxes. Subscriptions renew automatically until cancelled. You can manage or cancel your subscription from your account. Except where required by law, fees are non-refundable.
5. Acceptable Use
You agree not to misuse the Services, including by using them for unlawful, fraudulent, harassing, or deceptive purposes; violating telemarketing, call-recording, or consumer-protection laws; sending spam or unsolicited communications; attempting to disrupt or gain unauthorized access to our systems; or reverse engineering the platform.
6. Customer Data and Responsibilities
You retain ownership of the content and data you submit to the Services (“Customer Data”). You grant us a limited license to process Customer Data to provide and improve the Services.
You are responsible for your use of the Services and for complying with all applicable laws, including obtaining any consents required to record calls or contact your customers.
7. Third-Party Integrations
The Services may interoperate with third-party products. Your use of those products is governed by their own terms, and we are not responsible for third-party services or their availability.
8. Intellectual Property
The Services, including all software, content, and trademarks, are owned by CSAgentIQ or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these terms.
9. Service Availability and Changes
We work to keep the Services available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue all or part of the Services at any time, and will make reasonable efforts to provide notice of material changes.
10. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by law, CSAgentIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability arising out of or related to the Services will not exceed the amounts you paid us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold CSAgentIQ harmless from claims, damages, and expenses arising out of your use of the Services, your Customer Data, or your violation of these terms or applicable law.
13. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these terms or if necessary to protect the Services or other users. Upon termination, your right to use the Services ends, though certain provisions survive.
14. Governing Law
These terms are governed by the laws of the jurisdiction in which CSAgentIQ operates, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there, unless otherwise required by applicable law.
15. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated terms.
